Trademark registration in Japan
Plan the Japanese wording, the goods and services, and the later registration payment before filing.

The short answer
What should you know before filing in Japan?
Japan generally gives priority to the first applicant, but filing first does not make an unsuitable mark registrable. The JPO checks distinctiveness and conflicting rights. Protection depends on the named goods and services, not simply the class number. A direct application and a Madrid designation are alternative routes into the same Japanese examination system. [2][5][6]
A Japan-based representative and Japanese documents
For a direct filing, an applicant without a permanent address, residence or relevant business office in Japan must appoint a Japan-based representative, called a Patent Administrator. Required application documents are in Japanese. Agree the applicant's transliterated name and address before filing so that the record identifies the correct owner consistently. [1]
Which name versions should I bring for a Japan review?
List the exact Latin-letter spelling, any proposed Japanese-script version or kana reading, and the goods or services for each. Mark unsettled translations or readings as proposals. Use the existing Japanese name preparation guide to organise the details before professional review. Japan is not a supported region in Trademarkora Public Search.
Decisions to make before the Japanese filing
Start with the brand that will appear in Japan and the activities it needs to cover.
| Your situation | What to decide | Why it matters |
|---|---|---|
| An English name and a Japanese reading | Check how each version will be understood | Similarity assessment considers appearance, sound and meaning. A different spelling alone does not settle whether two marks conflict; include the proposed Japanese reading in the review. [2] |
| Several products within one class | Review the goods, not just the heading | The JPO uses similarity-group codes when examining related goods and services. Items in the same class are not automatically similar, and a class selection is not blanket protection. [2] |
| Japan is part of a wider launch | Compare direct filing with Madrid | Madrid requires an eligible connection to an Office of origin and a basic application or registration. It centralizes administration, while Japanese law still governs protection in Japan. [5][6] |

Planning example
A fictional stationery seller adds downloadable design software. The useful question is which products the Japanese filing should name, not whether its existing class number sounds broad enough.
Prepare for a useful review
Bring the spelling, reading and intended products together
The useful preparation unit is a mark version plus its intended reading and actual goods or services.
- Keep the Latin-letter artwork and each proposed Japanese rendering as separate files.
- Ask the language reviewer to confirm the intended kana reading; do not treat an automatic transliteration as an approved brand name.
- List the concrete products and services before researching JPO similar-group codes.
Planning example — not a client case
Hypothetical example: an English stationery brand adds a Japanese reading and launches a downloadable design product. A useful brief separates the mark versions and both product activities, so the reviewer can examine sound and scope without guessing.

Application preparation, goods and services wording, filing-quality review, approved electronic filing and standard completion through initial registration, within the agreed scope.
Separate when needed
Non-standard official fees, translations, notarisation, objections, opposition and later maintenance are outside the standard scope unless expressly included.
A direct filing has a later registration-payment stage. Registration and renewal fees may be paid for ten years or in two five-year installments; installments cost more overall. Calendar the applicable payment deadlines and any second installment separately. Overseas applicants arrange JPO payments through their Japanese representative. [4]

Examination and any response
The JPO checks formalities and substantive requirements. A refusal notice may require arguments or an amendment; the response and its deadline need a case-specific review. [3]

Our service planning reference is About 12 months for a straightforward application. This is not an official average or a deadline commitment. Document preparation, examination, objections or opposition can change the total time.
Prepare your application
This is our service-preparation checklist, confirmed 6 September 2026. It is separate from the official eligibility and procedural rules linked in this guide; requirements depend on the applicant and filing route.
Documents & details
- Trademark details, including the applicant’s name and address, the mark, and the goods or services.
- A scan of the business licence or personal ID.
- If you have filed a trademark or patent in Japan before, provide your JPO applicant code, or an earlier application or registration number.
Planning & records
- Filing acknowledgement estimate
- 3–5 working days
- Certificate format
- Electronic certificate
A filing acknowledgement is not a registration. Confirm the final checklist and schedule before approving a filing.
Direct JPO filing or Madrid designation?
Direct application
A national filing goes through the JPO with Japanese documents and the required local representative. Consider it when preparing a Japan-specific specification or handling Japan separately from the wider portfolio. [1]
The published filing prices on this page describe the standard direct application scope. A different route, additional territory or unusual requirement needs its own scope confirmation.
Compare countries and registration routes →Keeping the registration in force
A Japanese trademark term runs for ten years from registration and can be renewed. Prepare renewal during the six months before expiry, with the renewal payment; check any installment already scheduled. [4]
Three years or more of non-use after registration can expose a mark to a revocation challenge. Keep relevant use evidence; non-use is not an automatic finding that another business is free to adopt the mark. [3]
Keep the owner’s details, actual use records and renewal dates organised. A dispute or official notice needs its own review; it is not included automatically in a standard filing.
