Trademark registration in Hong Kong SAR, China

Plan a Hong Kong application with its own territory, filing language and service address in mind.

The short answer

What should you know before filing in Hong Kong SAR, China?

Apply to the Hong Kong Registry for local protection. Examination and acceptance precede a three-month opposition period. Registration follows if the application can proceed, with its date relating back to filing. [1]

A Hong Kong service address is essential

You may file directly or use an agent, but the application needs a valid residential or business address for service in Hong Kong. A post-office box, virtual office or address used only for forwarding mail is not acceptable. Keep this address current so official correspondence reaches the right person. [2]

Rule update to know

Madrid implementation remains a dated policy issue: recheck official commencement arrangements before choosing an international route for Hong Kong. [4]

Filing choices for Hong Kong SAR, China: situation, decision and practical implications
Your situationWhat to decideWhy it matters
You already have mainland China protectionPlan a separate Hong Kong filingA Madrid designation of China does not extend to Hong Kong. Do not treat an existing mainland certificate or an international registration naming China as a substitute for a Hong Kong protection decision. [5]
Your team works in Chinese and EnglishChoose the application language deliberatelyEither language can be used. The filing language determines the certificate, publication particulars and opposition proceedings, even if later correspondence uses the other language. [2]
The brand spans several product categoriesDescribe the activities and group the itemsHong Kong uses Nice Classification and permits additional classes within an application. List the particular goods and services; a broad class heading may not cover everything you intend to offer. [2]

A useful preparation example

Prepare a one-page launch brief with the legal owner, mark, products or services and who will receive official letters. Tell the reviewer whether your team wants Chinese or English documentation. Keep mainland and Hong Kong filings distinct in your checklist.

Prepare for a useful review

Check the market, the mark and who receives notices

A Hong Kong company record and a trademark registration answer different questions. Build the filing brief around the brand and activities needing Hong Kong protection.

  1. Identify the business selling in Hong Kong, the legal owner and the service contact.
  2. Provide the exact English and Chinese mark versions intended for local use.
  3. List mainland China, Macao and Taiwan plans separately rather than treating them as a single filing.

Planning example — not a client case

Hypothetical example: a brand has a mainland application and opens a Hong Kong shop. Bring the existing record as background, then define the Hong Kong name and activities as a separate protection decision.

Separate when needed

Non-standard official fees, translations, notarisation, objections, opposition and later maintenance are outside the standard scope unless expressly included.

Application fees are generally non-refundable if registration cannot proceed, subject to limited exceptions; ask separately about response or opposition work. [3]

From application to registration

  1. 1

Check the mark and filing details

Before applying, IPD recommends checking whether the proposed mark meets registration requirements and searching for potentially conflicting marks. Prepare the mark representation, applicant details and goods or services for the application. [3]

  2. 2

    Deficiency checks and examination

The Registry checks the application and examines whether the mark is registrable. If it objects, its opinion explains the issues. Responses and any permitted extensions need active attention; an unresolved objection may lead to a hearing. [1]

  3. 3

    Publication for opposition

Acceptance leads to publication in the Hong Kong Intellectual Property Journal. A third party may oppose within three months beginning on publication. Both sides may need to submit evidence, and opposition proceedings can carry an award of costs. [1]

  4. 4

    Registration and the record

The Registry enters the mark and issues a certificate when registration can proceed. Check the particulars against your filing instructions. [1]

As little as six months, if no deficiencies or opposition arise. [1]

Prepare your application

This is our service-preparation checklist, confirmed 6 September 2026. It is separate from the official eligibility and procedural rules linked in this guide; requirements depend on the applicant and filing route.

  • Trademark details, including the applicant’s name and address, the mark, and the goods or services.
  • A scan of the business licence or personal ID.
  • Provide a mark image for both word and design marks.

Electronic certificate

A filing acknowledgement is not a registration. Confirm the final checklist and schedule before approving a filing.

The current filing route

Direct application

Use a direct application to the Hong Kong Registry, filed electronically or by the available paper route. Complete the relevant application instructions rather than sending an existing overseas certificate alone. [3]

International & neighbouring markets

The government's 2026–27 briefing describes Madrid implementation as preparatory work, with formal Central Government agreement still to be sought after that work. Do not treat the 2020 enabling legislation as an operating Hong Kong Madrid route. [4]

The published filing prices on this page describe the standard direct application scope. A different route, additional territory or unusual requirement needs its own scope confirmation.

Keeping the registration in force

The registration term is ten years and can be renewed for further ten-year periods. The ordinary renewal window is the six months ending on expiry. [2]

A non-use revocation case can examine a continuous three-year period starting on or after the actual entry of the mark in the register. That actual registration date is distinct from the earlier filing-based registration date. [2]

Keep the owner’s details, actual use records and renewal dates organised. A dispute or official notice needs its own review; it is not included automatically in a standard filing.
