Trademark registration in Taiwan, China

Plan the owner, Chinese application wording and registration-stage tasks before preparing a Taiwan filing.

The short answer

What should you know before filing in Taiwan, China?

File with TIPO for Taiwan protection. After examination and approval, pay the registration fee within two months of service of the decision. Rights and the three-month opposition window begin with registration publication. [1]

A local trademark agent for overseas applicants

A foreign applicant without a domicile or place of business in Taiwan must appoint a locally domiciled trademark agent. TIPO explains that a foreign company with a properly established local branch may instead state that place of business and its representative. Confirm the actual applicant's position, rather than assuming every overseas applicant is treated alike. [3]

Prepare the application around the intended use

Bring these choices into the filing discussion while changes are still practical.

Filing choices for Taiwan, China: situation, decision and practical implications
Your situationWhat to decideWhy it matters
The mark covers more than one categoryConfirm the goods and services, then the filing structureOne application can contain one mark in several classes. Similarity is not determined solely by class numbers. Single-class filing may be a preparation choice, not a universal legal requirement. [1][2]
The proposed mark contains foreign wordsPrepare the Chinese application and the meaningTrademark application documents are in Chinese. The rules call for the language and meaning of foreign wording in the mark. Translations of foreign supporting evidence can be requested where TIPO considers them necessary. [2]
You are preparing a future launchMatch the scope to a genuine business intentionThe rules describe an intention genuinely to use the mark for the designated goods or services. TIPO may request evidence if needed during examination. A broad list should therefore reflect an actual plan, not simply every available class. [2]

A useful preparation example

For a planned launch, bring the name or logo, a product list and an explanation of foreign words. Explain which activities are underway and which are planned. Resolve wording and ownership questions before finalising the filing instructions.

Prepare for a useful review

Match the Chinese and English versions to the intended owner

Prepare the local mark presentation and registration-payment question at the same time as the initial filing brief.

  1. Provide exact Chinese characters, English artwork and the proposed goods/services list.
  2. Identify the owner and signatory on the authority document; distinguish the company identity from a trading name.
  3. Ask the final written scope to identify the later registration stage. The reference describes application plus grant, but does not by itself reconcile every fee with the published package.

Planning example — not a client case

Hypothetical example: a brand uses one English name internationally and different Chinese artwork locally. Give the reviewer both versions and their intended uses, rather than assuming that one spelling answers every protection question.

Standard package

Application preparation, goods and services wording, filing-quality review, approved electronic filing and standard completion through initial registration, within the agreed scope.

Separate when needed

Non-standard official fees, translations, notarisation, objections, opposition and later maintenance are outside the standard scope unless expressly included.

Registration follows approval and payment of the registration fee. Responses to objections or disputes involve separate procedures. [1]

From application to registration

  1. 1

    Prepare the application and authority

Provide the applicant details, mark representation, designated goods or services and any appointed agent's authority. Have the Chinese text checked against the intended mark and business activities; supporting-document translations depend on the applicable requirement. [2]

  2. 2

    Examination and response

TIPO examines registrability and earlier conflicts. Before issuing a refusal, it notifies the applicant of the reasons and allows a response. Review the actual notice rather than assuming an application receipt means approval. [1]

  3. 3

    Approval and registration publication

Follow the registration-fee instructions after approval. Registration publication is the point at which trademark rights arise; it is not merely an earlier announcement inviting objections before grant. [1]

  4. 4

    Post-registration opposition

A third party may oppose within three months after registration publication on the statutory grounds. An opposition can concern only part of the registered goods or services. [1]

Our service planning reference is 6–8 months for a straightforward application. This is not an official average or a deadline commitment. Document preparation, examination, objections or opposition can change the total time.

Prepare your application

This is our service-preparation checklist, confirmed 6 September 2026. It is separate from the official eligibility and procedural rules linked in this guide; requirements depend on the applicant and filing route.

  • Trademark details, including the applicant’s name and address, the mark, and the goods or services.
  • A scan of the business licence or personal ID.
  • Power of attorney: signed, stamped, scan.

Taiwan filing and wider international plans

Direct application

Apply through TIPO for Taiwan protection, using a local agent where required. An overseas company's qualifying local branch is a specific exception to the ordinary foreign-agent requirement, not an automatic exemption for every group company. [3]

International & neighbouring markets

Taiwan is not a contracting party to the Madrid System. TIPO explains that Taiwanese applicants with an eligible establishment or residence in a member jurisdiction may use that jurisdiction for international applications. That possibility concerns protection in Madrid members; it does not turn Taiwan into a Madrid designation. [4]

The published filing prices on this page describe the standard direct application scope. A different route, additional territory or unusual requirement needs its own scope confirmation.

Keeping the registration in force

Registration lasts ten years, renewable for further ten-year periods. Apply within six months before expiry; renewal within six months afterwards requires the prescribed increased fee. [1]

Three years without use, or a continuous three-year suspension without proper reason, can expose the registration to revocation. Keep commercial evidence and the registered particulars current; ownership of a certificate alone does not establish continuing use. [5]

Keep the owner’s details, actual use records and renewal dates organised. A dispute or official notice needs its own review; it is not included automatically in a standard filing.
