Trademark registration in Malaysia

Prepare a Malaysian trademark with the right owner, a registered agent for overseas applicants, a precise specification and a plan for examination, opposition and maintenance.

Prepared by Trademarkora · Official sources checked 9 September 2026

The short answer

What should you know before filing in Malaysia?

MyIPO administers Malaysian trademark registration under the Trademarks Act 2019 framework. Prepare a Malaysian application around the sign and goods or services actually needing protection. Company registration, a domain name and a marketplace listing answer different questions from a trademark register. [1]

Prepare the overseas owner and local filing arrangements

MyIPO's FAQ states that foreign applicants must appoint a registered trademark agent, while qualifying local applicants may file themselves. Check the agent arrangements before sending final instructions, and provide the correct overseas legal name, address, signatory information and earlier filings. [2]

Malaysia: decisions that shape your application

Malaysia's filing plan should distinguish the brand, the business activities and the applicant. Bring the real product catalogue and intended language versions into the discussion before reducing the plan to a list of class numbers.

Your company offers several different servicesDraft descriptions from customer transactionsExplain what customers buy, how it is delivered and whether the activity is software, professional advice, retail or another service. Use examples of actual work so the specification can be reviewed for local acceptance.
The brand includes words in several languagesShow every version intended for useProvide the Latin lettering, any Chinese characters, Malay wording or other script, their meaning and how they appear together. Ask which versions should be searched and whether separate applications are useful.

Planning example — not a client case

A Malaysian launch combines branded tea products, an online shop and tea-tasting events. The founder should explain these as three customer-facing activities and provide the actual packaging and event branding. The filing professional can then review the relevant terms and mark versions, avoiding a specification based only on the company's general trading description.

Prepare for a useful review

Prepare your Malaysia application brief

Use this practical preparation list to connect the official procedure with the information your filing professional will need.

  1. The overseas applicant's legal identity and registered trademark agent.
  2. Each language version with a description of how it will be used.
  3. Concrete customer transactions that explain the goods or services.
  4. Earlier applications and the ownership chain if priority is being assessed.

Planning example — not a client case

Brief example: for packaged tea and tasting events, prepare a table with one row per offering and columns for the actual sign, intended owner, launch date and evidence already available. Attach the final artwork and list unresolved questions separately, so the reviewer can distinguish facts from assumptions.

How much does trademark registration in Malaysia cost?

For the agreed mark, applicant, classes and filing route, the published all-in package covers the normal process through initial registration, including standard professional work and government application and registration fees, when there is no office action, refusal or opposition. Responses to objections or disputes, changes to the agreed scope and post-registration maintenance are quoted separately.

Standard package

Application preparation, goods and services wording, filing-quality review, approved electronic filing and standard completion through initial registration, within the agreed scope.

Separate when needed

Non-standard official fees, translations, notarisation, objections, opposition and later maintenance are outside the standard scope unless expressly included.

Use Trademarkora's current published quote for the agreed normal registration scope. The official sources describe government charges and procedural steps; do not add those charges to a package again without checking what is included. Extra classes, disputed proceedings, exceptional document work and later maintenance require their own scope. No amount on an old official form should replace the current quote.

From application to registration

  1. 1

    Approve the owner and mark

Prepare the owner identity, address, mark image and product/service descriptions. Record the approved spelling and design version so that website revisions do not silently change the filing instructions.

  2. 2

Check the current forms and fees

MyIPO maintains a forms-and-fees page for trademark procedures. Ask the representative to reconcile the selected classes and descriptions with the current application form, then keep the official receipt and application number. [4]

  3. 3

    Respond to examination

Use MyIPO's current trademark guidelines to understand examination and procedural requirements. A notice should be reviewed by issue: sign, description, earlier rights or missing information. Agree a response with the evidence and consequences explained. [3]

  4. 4

    Monitor publication and any opposition

MyIPO's opposition user manual describes a two-month period from advertisement. Confirm the applicable deadline and any available extension in the current rules and notice. Treat opposition as a distinct proceeding with its own response plan. [5]

  5. 5

Verify registration and build a portfolio record

Save the official outcome and compare the registered owner, mark and scope with the approved application. Maintain a record of notices, receipts and instructions so the person handling renewal can reconstruct the matter.

Our service planning reference is 12 months for a straightforward application. This is not an official average or a deadline commitment. Document preparation, examination, objections or opposition can change the total time.

Prepare your application

This is our service-preparation checklist, confirmed 6 September 2026. It is separate from the official eligibility and procedural rules linked in this guide; requirements depend on the applicant and filing route.

Documents & details

  • Trademark details, including the applicant’s name and address, the mark, and the goods or services.
  • A scan of the business licence or personal ID.
  • Class 5 food items and pesticide/disinfectant items must be prepared as separate applications.

Planning & records

Filing acknowledgement estimate
7–10 working days
Certificate format
Electronic certificate

A filing acknowledgement is not a registration. Confirm the final checklist and schedule before approving a filing.

Plan the actual territory and filing route

Direct application

A national application is filed through MyIPO using the applicable Malaysian formalities. Overseas applicants should arrange the registered agent identified in MyIPO's guidance and agree the specification before submission. [1]

International & neighbouring markets

Malaysia is a Madrid member. Eligible owners can compare designation with national filing; the Malaysian examination requirements still matter. [7]

The published filing prices on this page describe the standard direct application scope. A different route, additional territory or unusual requirement needs its own scope confirmation.

Keeping the registration in force

MyIPO's renewal guide describes ten-year terms and renewal in the six months before expiry. Late renewal and restoration have different procedures and additional charges. Confirm the recorded expiry and applicable route early; do not treat a restoration possibility as an ordinary renewal deadline. [8]

Keep dated evidence of the mark in Malaysian commerce, including relevant packaging, invoices, service material and authorised distribution records. A later use or cancellation question requires evidence matched to the goods and territory, not simply a statement that the brand is internationally known.

An ownership transfer, new address or changed brand presentation should prompt a portfolio review. Identify which registered details need an update and whether additional applications are appropriate. Do not assume the commercial agreement itself updates MyIPO's register.

Keep the owner’s details, actual use records and renewal dates organised. A dispute or official notice needs its own review; it is not included automatically in a standard filing.
