Trademark registration in Philippines

Prepare Philippine trademark registration with resident representation where required, a clear specification, publication monitoring and a Declaration of Actual Use calendar from the start.

The short answer

What should you know before filing in Philippines?

IPOPHL administers trademark registration in the Philippines. Its filing procedure is only the beginning of the portfolio plan: an applicant must also consider examination, publication and the later use-related maintenance requirements. Prepare the actual mark, owner and goods/services before submitting an application. [1]

Prepare the overseas owner and local filing arrangements

IPOPHL's eTMFile FAQ states that an applicant not domiciled and without a real and effective commercial establishment in the Philippines needs a resident representative. The FAQ also explains limits on direct foreign-applicant registration in the online system. Arrange the appropriate representative and notice-handling process before filing. [2]

Philippines: decisions that shape your application

The Philippines needs an early use-evidence plan as well as a filing plan. Teams accustomed to countries where routine administration centres on ten-year renewals can otherwise miss separate Declaration of Actual Use obligations.

Planning example — not a client case

A foreign skincare company plans a Philippine launch through a distributor. Its filing pack should include the legal owner, product list, packaging and resident representative details. Its operational plan should also identify who will preserve local sales and advertising evidence and who will instruct the required declarations after launch.

Prepare for a useful review

Prepare your Philippines application brief

Use this practical preparation list to connect the official procedure with the information your filing professional will need.

  1. Applicant details and resident representative arrangements where required.
  2. The exact mark, product list and planned Philippine launch date.
  3. The team member or distributor collecting dated actual-use evidence.
  4. Separate diary entries for filing, registration, use declarations and renewal.

Planning example — not a client case

Brief example: for skincare products launched through a distributor, prepare a table with one row per offering and columns for the actual sign, intended owner, launch date and evidence already available. Attach the final artwork and list unresolved questions separately, so the reviewer can distinguish facts from assumptions.

How much does trademark registration in Philippines cost?

For the agreed mark, applicant, classes and filing route, the published all-in package covers the normal process through initial registration, including standard professional work and government application and registration fees, when there is no office action, refusal or opposition. Standard package

Application preparation, goods and services wording, filing-quality review, approved electronic filing and standard completion through initial registration, within the agreed scope.

Separate when needed

Non-standard official fees, translations, notarisation, objections, opposition and later maintenance are outside the standard scope unless expressly included.

Use Trademarkora's current published quote for the agreed normal registration scope. The official sources describe government charges and procedural steps; do not add those charges to a package again without checking what is included. Extra classes, disputed proceedings, exceptional document work and later maintenance require their own scope. No amount on an old official form should replace the current quote.

From application to registration

  1. 1

Prepare and approve the filing particulars

Use IPOPHL's filing guidance to organise the applicant, mark representation and goods/services scope. Retain the final instructions and any earlier filing relevant to a priority assessment. [1]

  2. 2

    Submit through the appropriate channel

Confirm representative access and the correct applicant details before submission. Keep the official application number and filing date, and connect these with the approved specification and receipt. [2]

  3. 3

    Review examination correspondence

Read each notice for the affected goods, mark and procedural deadline. A response to an objection is a separate decision from merely correcting contact details; ask for the options and their effect on the commercial scope.

  4. 4

    Monitor publication and opposition

IPOPHL's glossary identifies a 30-day opposition period from publication. Check the current procedural rules and any extension or notice-specific requirement through the representative. Publication does not by itself establish an unchallenged registration. [3]

  5. 5

Verify registration and hand over maintenance

Check the registered mark, owner and goods/services, then record the grant date alongside the filing date. These dates have different roles in the maintenance calendar, so keep both rather than replacing the application record with only a certificate.

Our service planning reference is 6–10 months for a straightforward application. This is not an official average or a deadline commitment. Document preparation, examination, objections or opposition can change the total time.

Prepare your application

This is our service-preparation checklist, confirmed 6 September 2026. It is separate from the official eligibility and procedural rules linked in this guide; requirements depend on the applicant and filing route.

Documents & details

  • Trademark details, including the applicant’s name and address, the mark, and the goods or services.
  • A scan of the business licence or personal ID.
  • Power of attorney: signed, scan.
  • Keep the applicant address within 200 characters, including spaces.

A filing acknowledgement is not a registration. Confirm the final checklist and schedule before approving a filing.

Plan the actual territory and filing route

Direct application

A Philippine national application follows IPOPHL's filing process, including resident representation where applicable. Agree the specification and evidence responsibilities with the applicant and representative before filing. [1]

International & neighbouring markets

The Philippines is a Madrid member. Designation does not remove Philippine actual-use maintenance obligations; plan the local calendar for that route too. [6][4]

The published filing prices on this page describe the standard direct application scope. A different route, additional territory or unusual requirement needs its own scope confirmation.

Keeping the registration in force

IPOPHL lists Declarations of Actual Use within three years of filing, international registration or subsequent designation, and within one year of the fifth anniversary of registration or the statement granting protection. The precise trigger depends on the route. [4]

IPOPHL also lists a declaration within one year after renewal and within one year of the fifth anniversary of each renewal. Have the representative calendar the applicable dates, any permitted relief and the supporting evidence requirements. [4]

IPOPHL describes a ten-year registration term renewable for further ten-year periods. Renewal and use declarations are separate obligations. Maintain dated, mark-specific Philippine evidence and update the person responsible when distributors or internal staff change. [5]

Keep the owner’s details, actual use records and renewal dates organised. A dispute or official notice needs its own review; it is not included automatically in a standard filing.
