Trademark protection in mainland China, Hong Kong, Macao and Taiwan

Treat mainland China, Hong Kong, Macao and Taiwan, China as separate trademark protection scopes. An existing registration in one is useful background, but it does not give automatic registered protection in the others.

Separate the protection decision from the company structure

A company incorporated in Hong Kong may trade in several markets. Its place of incorporation does not turn its trademark registration into a regional right. Hong Kong IPD distinguishes the Hong Kong and mainland systems; Macao DSEDT likewise says a mainland registration must obtain separate Macao protection.

TIPO has its own application system. Its Madrid guidance says Taiwan is not a member of that international registration system. A Madrid plan therefore needs an actual territorial and eligibility check; a label such as 'China coverage' is not a complete instruction.

Make a four-row market map

Before calculating a budget, put the commercial reason for each territory in writing. A distributor negotiation, a local store, online sales and a manufacturing relationship may raise different questions. The map helps a professional assess those questions; it is not a rule that every activity always requires the same filing.

  • Mainland China: planned activity, English/Chinese marks, specific products and any existing CNIPA record.
  • Hong Kong: local brand presentation, goods/services and existing Hong Kong records.
  • Macao: intended activity and the class-by-class scope to review.
  • Taiwan, China: local presentation, applicant, products and any existing TIPO record.

Hypothetical example: manufacturing and two retail launches

A brand manufactures in mainland China, opens a Hong Kong shop and considers Taiwan sales next year. Its first useful document is a market map with those different activities and their dates. A Macao launch that remains speculative should be marked as such rather than hidden inside a generic regional request.

Attach existing registration records to the relevant territory. Keep English and Chinese versions separate, identify the proposed owner and highlight any third-party claim. This makes it possible to discuss sequence and risk without pretending that one application resolves every issue.

Avoid copying one specification across every application

Use one commercial product list as the starting point, but keep each office's final specification and application structure separate. Macao's official guidance identifies a single-class application structure. An administrative difference like this matters when matching documents and budgets to the requested scope.

An existing conflict needs its own route

If a supplier or distributor has filed a mark, collect the record and any official notice before choosing a remedy. The existing China conflict guide routes that question to the relevant service. The free preliminary check for a new application does not automatically include opposition, invalidation or non-use cancellation analysis.
