China trademark dispute service
Request an assessment of a China trademark invalidation case
Organize the target registration, relevant earlier rights or proposed grounds, dates, relationship evidence and objective before any recommendation.
Before any work begins
- ✓ Confirm service fit, jurisdiction, timing and conflicts
- ✓ Identify the responsible professional and needed records
- ✓ Provide separate scope, engagement terms and an Exact Quote if suitable
Sending an inquiry never authorizes payment, professional work, filing, recordal or monitoring activation.
Fit check
Is this the right service?
A registered China trademark may conflict with an earlier right or other proposed ground.
You have record dates or relationship evidence that needs professional review.
You need to scope the commercial objective and uncertainty before requesting a quote.
What we need first
- Registration number
- Relevant earlier rights or proposed grounds
- Filing and registration dates
- Known relationship or evidence
- Commercial objective
Do not wait for every item. Name, email, the trademark or record, a short message and consent are enough to start.
Controlled workflow
What happens after you ask
Scope, deadline and conflict review
We first confirm the record, jurisdiction, known deadline, requested scope and whether Trademarkora can act.
Exact quote and engagement
If the matter is suitable, you receive a separate scope, exact quote and engagement terms before any substantive work begins.
Evidence and drafting
After engagement, the responsible professional identifies the evidence and prepares the appropriate filing or response materials.
Client review and submission
You review the material before any authorized submission. Starting an assessment never authorizes filing or payment.
Pricing boundary
Exact quote after jurisdiction, record, deadline, scope and conflict review
Submitting this request does not create an engagement, payment, filing or legal conclusion. Any later work requires separate terms and customer approval.
Procedure and evidence
Build the grounds around evidence
Invalidation examines whether a registered mark should have been granted. The argument needs a recognised legal ground and evidence tied to that ground; a similar overseas registration or an unhappy supplier relationship does not decide the outcome by itself.
Prepare for an assessment
- Registration number, registered goods or services and key dates
- Earlier trademark, copyright, name or other rights you rely on
- Dated contracts and communications showing knowledge or authorisation
- Evidence of brand development, use and reputation relevant to the dispute
Keep the underlying records safely. Start with a short, non-confidential summary in the existing inquiry form; document handling can be agreed after the conflict check.
What this route does — and its limits
For specified relative grounds, the current law generally allows five years from registration. The bad-faith exception to that limit protects qualifying well-known trademark owners; it is not a general exception for every allegation of bad faith. Other grounds have different rules.
Keep filing strategy and any enforcement or response deadline under separate review. An invalidation request does not transfer the registration to you.
Sources checked 7 September 2026 · The 2026 revision takes effect on 1 January 2027; the applicable rules and any transition must be checked for your dates.
What a later scope may include
- ✓ Initial record, conflict, grounds and scope screening
- ✓ Questions about dates, relationship evidence and objective
- ✓ Separate Exact Quote and engagement if suitable
What is not included now
- — No public accusation or bad-faith label without evidence
- — No evidence analysis, drafting or filing before engagement
- — No promise that the registration will be invalidated

Practical questions
Frequently asked questions
Will Trademarkora label the owner as acting in bad faith?
No. Allegations are not facts. Any proposed ground must be supported and professionally assessed.
Why is there no public fixed price?
The necessary conflict review, grounds, evidence and scope vary by matter, so an Exact Quote follows case review.
Does submitting the form start proceedings?
No. It creates no engagement, payment, dispatch or government filing.
