China trademark dispute service

Challenge a registered China trademark for non-use

Organize the target registration, relevant goods or services, known use indicators and business reason before any eligibility conclusion.

Exact Quote after scope review

Before any work begins

  • ✓ Confirm service fit, jurisdiction, timing and conflicts
  • ✓ Identify the responsible professional and needed records
  • ✓ Provide separate scope, engagement terms and an Exact Quote if suitable

Sending an inquiry never authorizes payment, professional work, filing, recordal or monitoring activation.

Fit check

Is this the right service?

A registered China mark appears to block a planned application or market route.

You have identified possible non-use indicators but need the record and objective reviewed.

You want to scope whether a separate cancellation matter should be considered.

Status and timing boundary
Registration age or database status alone does not establish eligibility or non-use. The official record, relevant period, goods or services and available evidence must be checked.

What we need first

  • Registration number
  • Registration or approval date
  • Target goods or services
  • Known use or non-use indicators
  • Business reason for seeking clearance

Do not wait for every item. Name, email, the trademark or record, a short message and consent are enough to start.

Controlled workflow

What happens after you ask

1

Scope, deadline and conflict review

We first confirm the record, jurisdiction, known deadline, requested scope and whether Trademarkora can act.

2

Exact quote and engagement

If the matter is suitable, you receive a separate scope, exact quote and engagement terms before any substantive work begins.

3

Evidence and drafting

After engagement, the responsible professional identifies the evidence and prepares the appropriate filing or response materials.

4

Client review and submission

You review the material before any authorized submission. Starting an assessment never authorizes filing or payment.

Pricing boundary

Exact quote after jurisdiction, record, deadline, scope and conflict review

Submitting this request does not create an engagement, payment, filing or legal conclusion. Any later work requires separate terms and customer approval.

Procedure and evidence

Investigate non-use before applying

This procedure focuses on use during the legally relevant period. First confirm that the registration is old enough and identify the goods or services to challenge. A recent registration is not immediately eligible for a three-year non-use attack.

Prepare for an assessment

  • Registration details, publication date and the scope to challenge
  • Initial investigation of the registrant’s business and trading activity
  • Dated market, website and relevant e-commerce findings, with their limits
  • Known licences, sales or other use indicators, including contrary evidence

Keep the underlying records safely. Start with a short, non-confidential summary in the existing inquiry form; document handling can be agreed after the conflict check.

What this route does — and its limits

CNIPA’s 2025 guidance clarified preliminary investigation materials. Lack of a website is not conclusive. Genuine use, including use by an authorised licensee, or legitimate reasons for non-use may defeat the request. The outcome can concern only part of the registered scope.

Cancellation does not automatically give you the mark, guarantee your own application or resolve an infringement claim. Plan any new filing separately. If you received a non-use notice against your own mark, contact us to check the required response and whether we can assist.

What a later scope may include

  • ✓ Initial record, objective, conflict and scope screening
  • ✓ Questions about known use and the relevant goods or services
  • ✓ Separate Exact Quote and engagement if suitable

What is not included now

  • — No eligibility conclusion based only on age or status
  • — No investigation, evidence work or filing before engagement
  • — No promise that a registration will be cancelled
Human-first responsibility
A responsible professional must confirm the record, procedural basis, commercial objective and evidence plan. Database signals can inform review but cannot determine the result.

Practical questions

Frequently asked questions

Does an older registration automatically qualify?

No. Age and database status alone are not enough. The applicable record, period, scope and evidence must be reviewed.

Is this included in ordinary trademark filing?

No. Non-use cancellation is a separate matter with its own conflict check, engagement and Exact Quote.

Will the assessment clear the mark?

No. The assessment only helps determine whether Trademarkora can act and what a separately engaged scope may involve.
