Read China trademark records

How to Read China Trademark Search Results

Open the record behind the result. Confirm its number, compare the mark and listed goods or services, then read the dates and procedural history together. A match, an empty list or an inactive label cannot decide whether your proposed filing should proceed.

What to take away

  • Use the record number to return to the same filing.
  • Read the original status with its dates and available documents.
  • A class number cannot replace the actual goods or services.
  • Take relevant records into a preliminary professional check; do not convert them into a score or a guarantee.

1. Use this bilingual field glossary

This is a reading glossary, not a screenshot of the current CNIPA interface. Names and layout may differ between sources. If a field is missing, keep it as not supplied and check the underlying record.

Common Chinese record terms and what to check
Chinese termEnglish readingWhat to check
申请/注册号Application / registration numberUse it to identify the same record; an application is not proof of registration.
申请人名称Applicant nameThe party named in the application; confirm any later ownership change separately.
国际分类International classA starting point for reading scope, not a complete list of protected activities.
商品/服务项目Goods / servicesThe specific listed items and their relationship to your proposed business.
类似群Similarity groupRead with the goods or services and current China classification materials.
申请日期Application dateThe filing date; keep it separate from publication and registration dates.
初审公告日期 / 注册公告日期Preliminary approval publication / registration publication dateDifferent stages. Do not call a preliminary publication a completed registration.
商标状态 / 商标流程Status / procedural historyThe original label, relevant documents, dates and later changes.

2. Compare the sign and commercial scope

Start with the actual mark representation. A short text description may not capture a logo or combined mark. Compare relevant wording, sound, meaning and visual features; a similar sign need not be an exact spelling match.

Read the goods or services item by item. A close name for closely related products raises a different question from a name used in a different field. Neither a same-class match nor a different-class result is a complete conclusion. Keep any Chinese-character and pinyin candidates with the comparison.

3. Read status as a question to investigate

Trademarkora groups source records as Active, Pending, Inactive or Needs review to help you browse. These are summaries for reading records. Check the original status and available history before relying on a group.

A refused, cancelled or invalidated record is not an automatic green light. Check the decision, when it took effect, any review or court proceedings, and the rules applicable to a new filing. A partial decision may affect only some goods or services.

A status tells you what to verify next
What you seeWhat to check
Active / registeredWhich mark and goods or services are covered, and whether later events affect the record.
Pending / application in progressThe latest stage and documents; do not assume either registration or final refusal.
Inactive / cancelledThe event, affected goods or services, effective date and any later proceedings. An inactive group is not clearance.
Refused / invalidated / another decisionRead the original decision, its scope, effective date, later proceedings and applicable rules. These words alone do not determine a Trademarkora status group.
Needs review / unclearWhat is missing or inconsistent. Obtain better evidence before a filing recommendation.
No resultSearch scope, spelling, relevant versions and source limitations. No result is not an official clearance.

4. Keep dates and source limitations visible

A filing date, publication date and registration date describe different events. The date you searched is a separate observation. Keep those dates apart, and check whether a status comes from a current document or an older summary.

CNIPA explains that its online data may be delayed and is for reference only without legal effect. Missing information or an unavailable source does not become a favourable legal result. A professional may need to verify later documents before advising on your proposed filing.

5. Illustrative record: a cancellation label with missing detail

Fictional teaching example — not a live record. Imagine a result for “VELORA SAMPLE”, covering listed bags, with a summary saying “cancelled”. No decision date, document or affected-item details are supplied.

The correct next step is to obtain the decision and relevant history, confirm whether it covers the whole registration and check when it took effect. This example cannot establish that the mark is free to use or register. Do not replace missing facts with a favourable assumption.

6. Match the next step to your task

Still exploring a name? Refine the search. Preparing a China filing? Request a free preliminary professional check with your proposed mark and real goods or services. You do not have to complete a search before asking for that check.

If the issue concerns someone else’s existing registration, a dispute or an official notice, use the appropriate service page. A preliminary filing check does not include full opposition, invalidation or cancellation analysis.

Monthly China monitoring reports newly found exact-name records and visible changes after team confirmation. Your first exact name is free per customer; see the service page for additional-name pricing and prepayment terms. Monitoring does not assess similar names, establish infringement or manage official deadlines.

Worked example

Illustrative record: a similar name in an application

Fictional teaching example — no actual application or result is represented. Your proposed mark is “NORTH HARBOR” for footwear. A candidate labelled “NORTHHARBOUR EXAMPLE” has an applicant name, an application date, Class 25 and listed footwear; its summary says “Pending”.

The similar sound and listed goods make it worth examining. Open the mark representation, confirm the record number and check the latest procedural history. Pending does not mean registered, and it does not mean harmless. A preliminary professional check can assess the proposed filing with the relevant evidence; this example gives no registrability conclusion.

Mistakes to avoid

  • Treating the result count as a risk rating.
  • Assuming an applicant name proves the current owner.
  • Reading a preliminary publication as a completed registration.
  • Treating refusal, cancellation or invalidation as automatic availability.
  • Presenting a missing field, old status or failed query as a professional Stop or Proceed.
